Miles Herman and the extremely able James Stansfield of Counsel (Furnival Chambers) represented an individual facing an appeal under Section 28 of the Extradition Act 2003.
The Prosecution appealed a decision of the Senior District Judge that he was wrong in finding that a warrant seeking the arrest of this individual was not valid and was wrong in finding that extradition was not sought for an offence in accordance with the Act.
The Administrative Court dismissed the Prosecution’s Appeal out of hand and concluded that the warrant was not valid. The Prosecution had sought to say that an annex attached to the warrant should be included for the purposes of extradition proceedings.
This was a stunning success on behalf of an individual who, had they been extradited to France, would have been kept in custody awaiting trial for a considerable period of time.
Further, this was a case where bail was secured for the individual following a number of applications in the lower courts and, clearly, the individual is delighted by the outcome.
The Court had before them compelling submissions drafted by Counsel and took little persuading in dismissing the appeal.
